What are Site Agreements?

Site agreements are rental agreements between residents who own a movable dwelling (caravan for example) but rent the underlying land.

If the site is located in a caravan park, the laws relating to site tenants and site agreements will apply when:

  •  The dwelling is fully or partially owned by a site tenant
  • The dwelling has been designed, built/manufactured to be transported for use as a residence (does not include dwellings that can be registered with the Road transport regulator in your State)
  • It is the site tenant’s main home and not a holiday home
  • It is in a park on a rented site (not Crown land)

Site Agreements do not apply if the tenant:

  • Rents both the dwelling and the land (this is a residency in a caravan park)
  • Only uses the site for a holiday
  • Is renting the site under an employment agreement
  • Is living on a park in crown land
