Q: I need to evict a tenant as quickly as possible and I feel there is suspicious activity going on in my property. What are my options?
A: The quickest way to evict a tenant is to issue them with a legal notice identifying the following activity:
- Causing or allowing damage to the property
- Allowing the property to be used illegally
- Not complying with other lawful conditions of the lease agreement
Q: I have just become a strata owner in NSW. What are the rules regarding smoking in a strata property?
A: In November 2016, NSW introduced new legislation regarding smoking in strata properties:
- An owner/occupier/invitee, must not smoke tobacco or any other substance on the common property.
- An owner/occupier of a lot, must ensure that smoke caused by the smoking of tobacco or any other substance on the lot does not penetrate the common property or any other lot.
- An owner/occupier/invitee, must not smoke tobacco or any other substance on the common property unless it is an area designated as a smoking area by the owners corporation.
- A person who is permitted to smoke by the owners corporation, must ensure that smoke does not penetrate to any other lot or common property not designated as a smoking area.
