Leases- Know the different types

  • Co-Tenancy

This type of lease is signed by all tenants of the property. In a co-tenancy agreement each individual is considered as a collective, sole tenant.

All tenants are responsible for the property and payment of rent.

If one tenant fails to pay their share of the rent, all the tenants will be responsible.

  • Sub-Tenancy

A tenant can choose to share the lease and split the rent and choose the person who they want to share with.

  • Sub-Letting

A head tenant can choose to sub-let part of the property and also take on the legal responsibilities of the landlord. A dispute between a head tenant and sub-Tenant can be heard by VCAT

  • Rooming Houses & Boarding

Tenants that rent a room within a rooming house will not be named on the lease but may choose to have an exclusive room right. A tenant has the choice to share the room with someone of their choice or just occupy it themselves. Alternatively, the owner of the rooming house can choose who else lives in the room with a “shared room right” type of agreement.
