Pests:
Generally, as a landlord, you are responsible for pest and vermin control such as:
- Rats
- Mice
- Termites
The exception to this is that the presence of the pest has been caused by the tenant’s poor housekeeping or lack of hygiene and cleanliness.
For instance, if your tenant has not been disposing of perishable garbage, or has been engaging in activities that increased the presence of pests.
Mould:
Under tenancy law, a landlord must
- Keep the property in a reasonable state of repair
- Meet building, health & safety requirements
- Make sure repairs are undertaken in a reasonable period of time
Landlords may be in breach of the rental agreement if mould develops as a result of not attending to maintenance requests such as the following:
- Damp walls caused by plumbing malfunction
- Broken exhaust fans or wall mounted heating
- A leaky roof, broken pipes or flood damage
Where possible, respond to any reports of dampness before more mould can develop.
