What is Fair Wear & Tear?

“Fair wear & tear” occurs through normal daily use and covers the normal changes that take place when a property ages.

Sometimes this definition can be open to interpretation and be seen as a grey area, especially when it comes to the final inspection at the end of a lease period.

So what is a tenant responsible for and what is the landlord responsible for?

Here is a list of what tribunals would take into consideration when determining what is “Fair wear and tear”:

  • The duration of time tenants leased the property
  • How many resided in the property
  • The age of the property, fixtures and fittings
  • Current depreciation status of disputed items
  • The state of the property when the tenant took out the lease
